The decision is outlined in Decree Number 102/Pid.Sus-TPK/2025/PN Jkt.Pst, signed by Presiding Judge Fajar Kusuma Aji, along with panel members Khusnul Khotimah, Adek Nurhadi, Sigit Herman Binaji, and Mulyono Dwi Purwanto.

The judges approved Kerry’s transfer from the Salemba Detention Center of the South Jakarta Prosecutor’s Office to the Class I Jakarta Pusat State Detention Center (Salemba) on October 20, 2025. Kerry’s legal team had previously submitted a request for the transfer via a letter dated October 13, 2025.

“Granting the request of the Defendant Muhamad Kerry Adrianto Riza’s Legal Advisory Team,” the decree stated, as obtained by Republika on Tuesday, October 21, 2025.

In the decree, the panel cited Kerry’s health as a factor in their decision. The judges referred to a medical summary from Adhyaksa Hospital Jakarta, dated August 22, 2025, which stated that Kerry suffers from pneumonia (lung inflammation).

The relocation to the Class I Salemba Jakarta Pusat Detention Center was deemed more appropriate because the facility has accredited healthcare services from the Ministry of Health, capable of ensuring Kerry’s medical care. The accreditation is “paripurna,” signifying comprehensive capabilities.

Through the decree, the panel of judges instructed the Public Prosecutor of the Central Jakarta Prosecutor’s Office to execute the transfer of detention as soon as possible.

Meanwhile, Kerry’s attorney, Lingga Nugraha, expressed his support for the judges’ decision. Lingga believes the transfer was approved due to humanitarian considerations and legal necessities.

“We respect and appreciate the panel of judges’ consideration of our client’s health condition as a priority. This transfer also facilitates the legal process, both for the trial and if the prosecutor needs Kerry’s testimony in other cases,” Lingga told reporters on Tuesday, October 21, 2025.

In this case, the Prosecutor has accused Kerry of causing state losses calculated at up to Rp 285.1 trillion. One point of the indictment concerns the lease cooperation of the Merak Fuel Terminal, implicating PT Orbit Terminal Merak (OTM) and PT Jenggala Maritim, which is considered detrimental to the state.

Kerry is being tried alongside Commissioner of PT Navigator Khatulistiwa and Commissioner of PT Jenggala Maritim, Dimas Werhaspati, as well as Commissioner of PT Jenggala Maritim and President Director of PT Orbit Terminal Merak (OTM), Gading Ramadhan Joedo.
